My telegram No. 1719 paragraphs 10 and 11.

Following is form of texts as agreed subject to specified points as listed in my telegram under reference.

2. Preamble and nine articles of treaty as in our draft, modified by the Chinese amendments approved in your telegrams No. 1522, No. 1532 and No. 1629. Excellency" are inserted before "President".

Final words read as follows: "Done at Chungking this 1st day of January 1943 corresponding to 1st day of 1st month of 32 years of Republican China, in duplicate in English and Chinese, both texts being equally authentic".

3. Exchange of notes, First sentence of note is unchanged except for deletion of words "and India". part is amended to read as follows:-

"The understandings revised with regard to the se points are recorded in annexe signed which annexe shall be con- sidered as an integral part of the Treaty signed to-day and shall be considered effective upon date of entrance into force of that Treaty. I should be glad if Your Excellency would confirm these understandings on behalf of the Government of the United Kingdom". This form is suggested as an improvement on that proposed in paragraph 9 of my telegram

4. My reply will read as in my telegram No. 1701 without words: "and of India" As in the case of the Treaty its notes and annexe will be in English and Chine se both versions being signed.

5. Annexe, first four paragraphs. First paragraph begins with words: "With reference to Article 2 and Artiole 8 (2) of Treaty it is understood". Then follows clauses (A) to (G). Clause (A) reads as in my telegram No. 1723, clauses (B) to (F) as in our draft except for clause regarding pilota which is modified in accordance with paragraph 8 of my telegram No. 1677. Clause (G) is as in paragraph 3of your telegram No. 1602 and paragraph 1 of your telegram No. 1616.

6. Second paragraph is as in our draft. Third paragraph Subject to acceptance by Chinese) as in my immediately following telegram. Fourth paragraph as in paragraph 6 of

our draft.
